Agreement

By using DevSwat Inc. services — including the website at dev-swat.com, the client dashboard, our ChatGPT GPTs and MCP connectors — you agree to these terms. If you don't agree, don't use the service.

Who we are

The service

DevSwat is an AI and automation development agency. We scope and deliver custom software projects (web apps, mobile apps, custom GPTs, Telegram bots, agentic systems, hosting and payments integrations). The assistant on our site, in ChatGPT GPTs, or in MCP connectors is a scoping and workflow tool — it produces estimates and routes you through the ordering flow.

Projects, quotes and payments

• Quotations are estimates until both parties confirm scope in writing (an accepted quotation in the dashboard counts as writing).
• Payment: 50% advance when a quotation is accepted, 50% on delivery, paid by Stripe. All amounts are in USD unless stated otherwise.
• Buffer: a 14-day sign-off window applies after delivery before the final amount is fully released.
• Add-ons and consultations are billed per their own line item.
• Refunds: unpaid balances can be cancelled free of charge before work starts. Once work has begun, we refund in good faith for the portion not yet delivered.

Acceptable use

Do not use the service to:

• Build or request illegal content or infrastructure.
• Infringe third-party rights or privacy.
• Abuse, probe or disrupt our systems or the sub-processors we rely on.
• Submit someone else's personal data without their consent.

Quality guarantee

If something we shipped doesn't match the agreed scope or breaks within 30 days post-delivery under normal conditions, we fix it at no extra cost. Changes outside the agreed scope are billed as add-ons.

Intellectual property

Once a project is paid in full, you own the resulting source code and deliverables except for general-purpose components we re-use across projects, which remain ours under a perpetual license to you.

Warranties and liability

The service is provided "as is" without warranties of any kind except those that cannot be disclaimed by law. To the maximum extent permitted, DevSwat Inc.'s total liability for any claim arising out of the service is limited to the amount you actually paid us in the 12 months preceding the event giving rise to the claim.

Suspension and termination

We may suspend or terminate access for violation of these terms, non-payment, or abuse of the service. On termination we will give you a reasonable period to export your project data.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Venue for disputes is the state and federal courts located in California.

Changes

We may update these terms from time to time. Material changes will be announced on this page.
